How Does the Process Work?

First, the person fills out Canada refugee claim (PIF) for the IRB. Then, around 12 months later, they go to a meeting with an IRB member. Sometimes, if they submit proof as clear as day, the officers accept them without a meeting, but that’s not common.

If the Immigration and Refugee Board (IRB) declares that the person is a real refugee, they become protected and may apply for permanent residence in Canada. But if the IRB does not seem so, in that case, the person can ask the Federal Court of Canada to review the Canada refugee claim. If that doesn’t work, they might have to leave Canada.

Before leaving, they can ask for a Pre-Removal Risk Assessment (PRRA). It’s like a refugee claim but looked at by a Canadian immigration official, not the IRB. If the case has already been decided by the IRB, only new changes since that decision will be considered. Sometimes, even people who can’t make a refugee claim can ask for a PRRA.
